معاهده تجارت تسلیحات و جمهوری اسلامی ایران: تهدیدها و فرصت‌ها

معاهده تجارت تسلیحات نخستین هنجار بین¬المللی حقوقی در حوزه تجارت تسلیحات متعارف است که در 2 سال 2013 در مجمع عمومی ملل متحد تصویب گردید. آن‌گونه که از متن سند برمی‌آید، معاهده دو هدف عمده ایجاد بالاترین معیارهای بین¬المللی ممکن برای تنظیم یا بهبود مقررات تجارت بین¬المللی تسلیحات متعارف و دیگری جلوگیری و ریشه¬کنی تجارت غیرقانونی تسلیحات متعارف و جلوگیری از انحراف آن¬ها را پی می‌گیرد. قابل‌توجه‌ترین موضوع در این معاهده، دامنه وسیع تبادل و تسری دادن موازین موردنظر غرب به کمیت و کیفیت تجارت تسلیحات است. پژوهش حاضر با استفاده از روش تحقیق توصیفی- تحلیلی و باهدف آشنا نمودن متولیان امور در جمهوری اسلامی ایران از تهدیدها و فرصت‌های معاهده، به این نتیجه کلی دست‌یافت که معاهده تجارت تسلیحات، سندی محدودیت زا برای تجارت تسلیحات برای جمهوری اسلامی ایران محسوب می‌شود که بر مبنای هنجارها و ارزش‌های غربی طراحی‌شده است؛ اگرچه از مفرهای موجود در این معاهده برای حداکثر سازی فرصت¬ها و به حداقل تهدیدات نیز می¬توان بهره گرفت.

Arms Trade Treaty and the Islamic Republic of Iran: Threats and Opportunities

Abstract

The Arms Trade Treaty is the first international legal norm in the field of conventional arms trade to be adopted by the UN General Assembly in 2013. According to the text of the document, the treaty pursues the two main objectives of establishing the highest possible international standards for regulating or improving the rules of international arms trade, and the other is to prevent and eradicate the illicit trade in conventional arms and prevent their diversion. . The most notable issue in this treaty is the wide range of exchange and extension of Western standards to the quantity and quality of the arms trade. The present study, using a descriptive-analytical research method and with the aim of acquainting the authorities in the Islamic Republic of Iran with the threats and opportunities of the treaty, came to the general conclusion that the arms trade treaty is a restrictive document for arms trade for the Islamic Republic of Iran. The basis of Western norms and values ​​is designed; However, the loopholes in this treaty can be used to maximize opportunities and minimize threats
